Monsanto/DuPont GMO spat concludes

A US federal appeals court has upheld a lower court's ruling to sanction DuPont seed subsidiary DuPont Pioneer in a lengthy dispute over the licensing of Monsanto's glyphosate tolerance technology in genetically modified crops. The US Court of Appeals for the Federal Circuit agrees with the decision by the US District Court for the Eastern District of Missouri to impose sanctions on DuPont by striking its contract reformation defence and counterclaims and awarding Monsanto lawyers' fees.  The District Court "did not clearly err in finding that DuPont had misrepresented its subjective belief concerning the licence in order to maintain its reformation claims", the Court of Appeals states. "We further conclude that the District Court did not abuse its discretion in imposing its narrowly tailored sanctions."
